It is not the Tribe’s policy to encourage relinquishment of parental rights, and such action is not to be taken lightly. Parental rights may be relinquished by a parent in writing, if signed by the parent in the presence and with approval of the Court. Relinquishment shall not be accepted or acknowledged by the Court prior to ten (10) days after birth of the child. The Tribal Court must find prior to approving the relinquishment that the parent understands the consequences of the relinquishment, and has made a knowing and intelligent waiver of all of his or her parental rights subject to the modification order, that his or her parental rights will be modified, and that the parent’s decision may result in adoption of the child.
