Any person may file a petition for adoption. The person proposing to adopt may initiate the petition. In the case of married persons maintaining a home together, the petition shall be the joint petition of husband and wife, except that if one (1) of the spouses is the biological or adopted parent of the proposed adoptee, said parents shall not be required to join in the petition.
