(A) Establishment. Pursuant to Resolution No. 91-R-12, dated April 12, 1991, the Tribal Council at a duly called meeting established a standing Enrollment Committee consisting of five (5) members.

(B) Appointment. The Tribal Council shall appoint a Tribal member who is at least eighteen (18) years old to serve as a Committee member when a vacant position is available. Each new Committee member shall be appointed one (1) month following the annual Tribal election. Any member that misses three (3) consecutive meetings without contacting the Enrollment Chairman and without a good excuse can be removed by a majority vote of the Tribal Council. At such time, the Tribal Council may appoint another member to serve the respective term of office. The Enrollment Committee shall elect among the Committee members a Chairman, Vice-Chairman, and Secretary on an annual basis.

(C) Terms of Office. Enrollment Committee members and alternate Enrollment Committee members are appointed by the Tribal Council in staggered four (4) year terms.

(D) Enrollment Committee Duties. The Enrollment Chairman shall preside at all meetings of the Committee.

The Enrollment Chairman shall assume general supervision of all officers and Committee members.

The Enrollment Chairman will be responsible for coordination of all official business with or between Tribal Chairman, Council or designee.

The Enrollment Chairman shall be responsible for informing the Tribal Council on all recommendations and progress of the Enrollment Committee as requested by the Tribal Council.

The Enrollment Chairman shall receive a copy of all requests pertaining to appeals, disenrollment, relinquishments and any correspondence related to enrollment.

The Enrollment Chairman, together with the Secretary of the Committee, shall sign on behalf of the Enrollment Committee all official Enrollment Committee papers within their authority to do so.

The Enrollment Vice-Chairman shall, in the absence of the Enrollment Committee Chairman, act as Chairman, and when so residing, shall have all rights, privileges and responsibilities as the Enrollment Committee Chairman.

The Secretary of the Tribal Enrollment Committee shall in the absence of the Enrollment Committee Chairman and Vice-Chairman act as Chairman, and when so residing, shall have all rights, privileges and responsibilities as the Enrollment Committee Chairman. The Enrollment Secretary shall be responsible for all correspondence, issuing public notices, the recording, publication and distribution of the minutes of the Tribal Enrollment meetings and receiving all petitions.

(E) Removal from Office. If a member of the Enrollment Committee shall die, resign, or be found guilty of a felony or a misdemeanor involving dishonesty in any Tribal, state or federal court, the Council shall declare the position vacant and appoint a new Committee member to fill the unexpired term.

(F) Committee Review. The Enrollment Committee should meet no less than once a month to review applications and/or conduct enrollment business. A quorum exists when at least three (3) members are present. All enrollment meetings shall be closed session to keep confidentiality of the applicants’ files.

The Enrollment Committee shall review and take action on an application within forty-five (45) days of receipt of an application.

The Enrollment Committee shall review all enrollment applications and adoption petitions and shall consider the information provided in such applications, together with all other available evidence concerning each applicant’s eligibility for membership.

The Enrollment Committee will submit its written recommendation as to whether the application should be approved or rejected to the Tribal Council. When the Committee finds additional information is needed, it may request such information in writing from the person as well as the applicant’s appearance before the Committee for a personal informal interview. The content and form for such written recommendation shall be approved by the Tribal Council.

If no additional evidence is received by the Enrollment Committee within sixty (60) days from the date on which the Enrollment Committee invites the submission of additional evidence, or if additional evidence submitted fails to prove eligibility, the Enrollment Committee shall recommend rejection of the application and shall provide reasons for rejection and the rights of the applicant to appeal such action to the Tribal Council’s next general Council meeting as outlined in KTC 2.05.150.

(G) Responsibilities. It will be the responsibility of the Enrollment Committee to assure that all applicants are treated fairly and equally. All applications are to be processed in a timely manner. The Committee shall prepare and provide to the Tribal Council all recommendations for Council approval. The Committee shall annually review the Tribal roll to assure that all deceased, relinquished and disenrolled members are identified.
