(A) The Tribal Council hereby recognizes the serious consequences of fractionated heirships of reservation, trust and other restricted Tribal lands. In an effort to prevent further fractionation, the Council hereby enacts this Probate Code for the following purposes:

(1) To encourage Tribal members to plan for the transfer of their property upon their deaths by making wills;

(2) To ensure that the property of the decedent passes to the rightful heirs or beneficiaries;

(3) To provide a simple, efficient and inexpensive means for probating decedent’s property;

(4) To comply and preserve Tribal custom and tradition;

(5) To prevent the transfer of land out of Tribal ownership and control;

(6) To insure that the rights of any creditors of decedent are fairly protected;

(7) To promote and further the Tribe’s inherent right of self-governance.
