(A) Pursuant to Section 12.3(a) of the Compact, the Tribe will adopt and comply with state public health standards for food and beverage handling within the gaming facility.

(B) The gaming facility shall also comply with the Tribal Liquor License Ordinance and any other applicable ordinance or policy adopted by the Tribe.

(C) The Tribe will permit inspections under this section at the gaming facility, by the state of California and Siskiyou County health inspectors, during normal hours of operation. These inspections will be limited to assessing compliance with these standards addressed in this article, unless such inspections are routinely made by an agency of the United States to ensure compliance with equivalent standards of the Unites States Public Health Service. Any report or other written document prepared by the inspector shall be transmitted to the State Gaming Agency and the Tribal Gaming Commission within twenty-four (24) hours of its issuance to the gaming facility.

(D) The Tribe acknowledges that the city of Yreka has delegated to Siskiyou County the health inspections identified in the Compact, and recognizes the county’s delegated authority to perform inspections as required under the Compact to ensure compliance with applicable health regulations.

(E) Nothing herein shall be construed as a submission of the Tribe to the jurisdiction of the state or county health inspectors. Any violations of the standards in Section 12.3(a) of the Compact shall be treated as violations of the Compact and may serve as a basis to issue, pursuant to Section 13 of the Compact, orders requiring corrective action, including an order to enjoin the food and beverage operations of the gaming facility where warranted to protect public health or safety.
