Pursuant to Sections 12.3(c) and 6.4.2 of the Compact, the gaming facility shall, at a minimum, comply with all applicable codes as that term is defined in Section 2.1 of the Compact. Any modifications or expansions made to the gaming facility shall meet or exceed the applicable codes. The Tribe shall permit the state to inspect the gaming facility during construction, modification, or maintenance; provided, that such inspections shall be limited to assessing compliance with the applicable codes.
